Sealy Friday Facebook Feed Competition Terms & Conditions

Instructions on how to enter this competition are included as part of these conditions of entry. By participating, entrants agree to be bound by these conditions.

  1. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. The entrant releases Facebook from all liability in relation to the promotion. The entrant is providing information to the promoter and not to Facebook.
  2. The promoter is Madad Pty Limited (ABN 57 009 678 344) of 1299 Boundary Road, Wacol QLD 4076
  3. The competition commences on Fridays if and when the competition is posted using a status update on the Sealy Australia Facebook page and concludes at 4:00pm AEST the same day (“Promotion Period”).
  4. Entry is open to Australian residents aged 18 years or older who have an account with Facebook, enabling them to submit an entry in accordance with item 5 below. Employees and their immediate families of the promoter, its retailers, suppliers and associated companies and agencies are not eligible to enter.
  5. To enter the competition, participants must, during the Promotion Period: login to their Facebook account, go to the competition post and submit a comment that answers the question and/or direction detailed in the Facebook competition post.
  6. The promoter reserves the right to verify the validity of entries and to disqualify any entrant whom the promoter believes either has tampered with the entry process, or has submitted an entry otherwise than in accordance with these conditions of entry.
  7. All valid entries received during the Promotion Period will be reviewed by the judging panel. This is a game of skill and chance plays no part in determining the winners. Each entry will be individually judged based on originality, creativity and successfully answering the question or direction provided in the competition post (“Judging Criteria”).
  8. Entrants may submit no more than one entry. If multiple entries are received, the first entry submitted by the entrant will be deemed valid and all other entries submitted by the same entrant deemed invalid.
  9. The entry or entries deemed by the judging panel to best address the judging criteria outlined in item 7 will be designated the winner and win a Sealy Posturepedic Merchandise Pack. The value of this prize will be $100 or less at any given time and be comprised, but not exclusively limited to, a variation of any combination of the following items: A Sealy Posturepedic Branded Tote Bag; A Sealy Posturepedic Branded Drink Bottle; A Sealy Posturepedic Branded Hat; A Sealy Posturepedic Branded Tape Measure; A Sealy Posturepedic Travel Mug; A Sealy Posturepedic Mouse Pad; A Sealy Posturepedic Branded Pen; and A Sealy Posturepedic Branded Note Pad.
  10. Prize winners will be announced at the discretion of The Promoter following the conclusion of the Promotional Period.
  11. Total prize value does not exceed $100. Prizes are not exchangeable, transferable or redeemable for cash.
  12. If the promoter is unable to supply the nominated prize, the promoter reserves the right to supply another prize of equal or greater value.
  13. All entries become the property of the promoter. The promoter’s decision is final and no correspondence will be entered into. No responsibility is accepted for entries not received by the promoter. Entries will be deemed invalid if stolen, forged, mutilated or tampered with in any way.
  14. Entrants warrant that their entry in the competition does not infringe the intellectual property rights of any third party. The entrant indemnifies and will keep the promoter and its associated agencies indemnified against any loss, costs (including legal costs), expenses or liability the promoter and its associated agencies may suffer arising out of a breach by the entrant of this clause.
  15. The stated prize value is the recommended retail value (including GST) in Australia as provided by the supplier and is correct at the time of printing. The promoter accepts no responsibility for any variation in the value of the prize. The promoter and its associated agencies and companies accept no responsibility for prizes damaged or lost in transit.
  16. The prize winner or winners will be notified via a comment on the competition post here following the conclusion of the competition period and be requested to provide postage details via Facebook Direct Message to claim the prize.
  17. In the event that a prize awarded is not claimed by 11:59pm the Wednesday immediately following the competition, the winner will forfeit the prize and neither cash nor any other prize will be awarded in lieu of that prize.
  18. If any winner is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian on their behalf.
  19. Any costs associated with entering the competition and accessing the Sealy Australia Facebook Page are the responsibility of the entrant.
  20. Failure by the promoter to exercise any of its rights contained within these terms and conditions at any time does not constitute a waiver of those rights.
  21. Entrants agree, at the promoter’s request, to participate in any promotional activity (such as a Facebook Post) surrounding this competition or the winning of any prize. Entrants agree that they will not be remunerated for this participation. Entrants consent to the promoter and its associated agencies’ using their name and image in any media in perpetuity, without limitation and without compensation to the entrant.
  22. These terms and conditions do not, nor do they purport to, limit, exclude or modify any non-excludable statutory guarantees as provided under the Competition and Consumer Act 2010, or any other warranties (whether express or implied) under any state or federal legislation which cannot be excluded.
  23. Except for any liability that cannot by law be excluded, the promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  24. To the fullest extent permitted by law and without limiting any other conditions of entry, the promoter may, in its discretion, terminate, modify or suspend the promotion. All entrants participating in the promotion at the point of termination, modification or suspension of the promotion will be notified by the promoter in writing. In the event of modification or suspension of the promotion, the entrant may choose to terminate their participation in the promotion at no cost.
  25. The promoter assumes no responsibility, and the entrant releases the promoter from responsibility, for any failure to receive an entry or for inaccurate information or for any loss, claim, damage or injury to person or property (including computer systems and servers) as a result of the entrant’s participation in this promotion or the conduct of the promotion generally or as a direct or indirect result of an entrant’s error, any technical problem (including communications or network failure, unauthorised access to, transferral of, or theft of, data), whether caused by the entrant, or associated with the equipment or programming used in the conduct of this promotion. If, because of any such problem, this promotion is not able to be conducted as planned and/or the promotion’s administration, security, fairness or integrity are compromised or affected, the promoter may cancel, terminate, modify or suspend the promotion and/or disqualify any entrant involved in interfering or tampering with the conduct of this promotion in any way.
  26. Details from all entries will be collected and used for the purposes of conducting this promotion (which may include disclosure to third parties for the purpose of processing and conducting the promotion) and for publicity purposes surrounding this promotion. By entering this promotion entrants consent to the use of their information as described.
